Prenuptial Agreements
A prenuptial agreement is a contract between prospective spouses that addresses the financial rights between those spouses in the event of divorce or death during the marriage. A prenuptial agreement, if well drafted, will reduce litigation in the event of a divorce, provide certainty as to the outcome of the issues covered by a prenuptial agreement, and reduce attorney fees that would otherwise be incurred resolving the issues covered in a prenuptial agreement.
When a Prenuptial Agreement is Needed
A premarital agreement may be appropriate in a number of situations. If you have been married before and are entering into your next marriage with wealth you previously acquired, you may want to consider a prenuptial agreement to protect and preserve your premarital assets, especially if you desire to protect a home, business or interest in a business, particularly a family business.
If you have a child or children from a prior relationship, a prenuptial agreement is important to protect your children’s potential inheritance. If you anticipate receiving an inheritance or gifts from your parents or a relative, a prenuptial is important to protect those assets as well. Parents with means also encourage their children to consider a prenuptial agreement to protect future gifts from the family or interests in family businesses from being shared in the event of divorce.
